Second criterion: what can you prove. An AI phone agent continuously produces three types of artefacts: the raw audio recording, the time-stamped textual transcription and the log of automated actions (appointments booked, qualified leads, transfers performed). Each of these artefacts must be accessible, exportable and purgeable according to your retention policy.

The concrete questions to ask the provider: who can access the recordings internally at the provider, under which conditions and with which traceability. Is there a Data Processing Agreement (DPA) compliant with the GDPR formalising the processor role. What is the default retention duration, and is it configurable.

Third criterion: compliance with article 50 of the AI Act, applicable on 2 August 2026. This article requires that any person interacting with an AI system be informed of that interaction, unless it is obvious.
